Terms and Conditions – Commsupport Networks

1. APPLICABILITY
The Purchaser contracts with Commsupport Networks. on its own behalf and on behalf of persons (delegates) who are enrolled by the Purchaser on Commsupport Networks. Courses including courses on Commsupport Networks provided premises (facilities and seminars), on Purchaser provided premises (onsite courses) or who receive packaged courses ordered on their behalf by the Purchaser. These terms and conditions supersede and replace any previous agreements, proposals or representations made between the Purchaser and Commsupport Networks for the provision of Facilities and seminars, Onsite courses and packaged courses. These terms and conditions shall prevail notwithstanding any terms and conditions contained in any order submitted by the Purchaser. Any variation must be agreed in writing by Commsupport Networks. The Waiver by Commsupport networks of any breach of any term of this Agreement shall not prevent the Subsequent enforcement of that term and shall not be deemed to be a waiver of any subsequent breach.

2. AUTHORISATION
The Purchaser hereby certifies that all Delegates are employed directly by, or are under contract to, the Purchaser and undertakes to bring these terms and conditions to the attention of Delegates

3. CONFIDENTIALITY AND COPYRIGHT
The Purchaser and Delegates will not: (a) disclose or provide or make available to any person other than the Purchaser or Commsupport Networks, or remove from Commsupport Network’s premises any Commsupport Networks program materials or copies thereof acquired as a result of receiving Commsupport Networks Services without Commsupport Network’s prior consent. (b) copy in whole or in part of any program materials acquired as a result of receiving Commsupport Networks Services except under the supervision of or in accordance with the instructions of Commsupport Network’s Personnel. Program materials consist of the basic material and their related optional materials for Commsupport Networks program products, Commsupport Networks special programs, and other Commsupport Networks licensed programs. NOTE: Commsupport Networks materials and courses are provided for the exclusive use of the Purchaser and Delegates. All rights in such materials and courses are reserved. The recording, copying, loan, unauthorised hire, public showing or broadcasting of such materials and courses are prohibited.

4. START DATE/DELIVERY
(a) Onsite Training and Facilities and Seminars will commence on the date specified by Commsupport Networks in the confirmation of acceptance issued to the Purchaser. Packaged Courses will be delivered to the Purchaser as soon as reasonably practicable. Commsupport Networks shall not be liable for any costs or damages suffered by the Purchaser or Delegates as a result of any delays in delivery of Packaged Courses or the cancellation or postponement of either Onsite Courses or Facilities and Seminars.

5. SCHEDULING CLASSES
We will specify the dates of public scheduled classes. We may cancel any scheduled class on notice. If Commsupport Networks cancel a class for which the purchaser has prepaid, Commsupport Networks will refund the price for the course. Commsupport Networks shall not be liable for any costs or damages suffered by the Purchaser or Delegates as a result of any delays in delivery of Packaged Courses or the cancellation or postponement of either Onsite Courses or Facilities and Seminars. Commsupport does not provide monetary compensation for any additional expenses incurred such as hotel/travel/loss of earnings for courses which are delayed or canceled

6. WARRANTY
All materials and audiovisual media e.g. video cassettes, audio tapes, and workbooks supplied by Commsupport Networks are warranted for a period of thirty (30) days. Computer media, e.g. Disk packs, Magnetic tapes, etc., are warranted against defects in material and workmanship under normal proper use in its original and unmodified condition for the period set forth above. If found defective by Commsupport Networks within the terms of this warranty, Commsupport Network’s sole obligation shall be to repair or replace (at its option) the defective product. If Commsupport Networks determines the product is not defective within the terms of this warranty, the Purchaser shall pay all costs of handling and return transportation. All replaced products become the property of Commsupport Networks.

Commsupport Networks shall not be liable for any errors or omissions in any written material supplied by Commsupport Networks. Except for the express warranties stated in this clause. Commsupport Networks disclaims all other warranties whether express or implied by statute common law or otherwise, and save as detailed in Clause 4 the warranties in this clause are in lieu of all obligations and liabilities on the part of Commsupport Networks for damages arising out of or in connection with the use or performance of its product. In no event shall Commsupport Networks be liable for indirect or consequential loss suffered by the Purchaser or Delegates and arising out of Commsupport Network’s performance under this agreement.

7. CANCELLATION AND TRANSFER
a. Commsupport Networks reserves the right to cancel or re-schedule training courses or events, in which case it shall use reasonable endeavors to notify the Purchaser. In the event of cancellation, Commsupport Networks shall refund the course fees which the Client has already paid in advance in relation to the canceled course. Commsupport Networks reserves the right to withhold services or provide reduced services if the Delegate attending on the Purchaser’s behalf fail to satisfy course requirements or meet the course prerequisites.

b. The cancellation and/or re-scheduling fees set out below shall apply in the event a course (or the Delegate’s attendance at a course) is cancelled or rescheduled at the Purchaser’s request. Commsupport Networks may issue a supplementary fee invoice to the Purchaser for such cancellation and/or re-scheduling fees and the Purchaser shall make full payment to Commsupport Networks within fifteen (15) working days of the date of that invoice:

9. Free course resits
1.The free offer is subject to available places on the requested date, requests for free courses cannot be made until 3 days prior to the first day of a chosen course.

2.To be eligible for the free course resit offer the student must have attended the original course in full, any absence from any of the course dates invalidates the offer.

3.Two free re-take places available per course on a first come first served basis

4.Students which attend the weekday courses can attend free retakes on the equivalent weekday courses only

5.Students which attend the weekend courses can attend free retakes on the equivalent weekend and weekday courses only

6.The first retake must be taken within one year of the start date of the original course

7.Free Re-sits apply only to physical classroom courses. Free Re-sits are not available on the Virtual Classroom Courses.

8.The final decision rests with the company

10. Attendance of Combination packages time limited
All courses must be sat within 6 (six) months of the course booking.

11. Exam voucher conditions
To qualify for the exam voucher the candidate must:

1. Exam vouchers/Exam booking must be requested within 90 days of the last day of the course
2. All exam vouchers are valid for 90 days from the last day of the course. Where more than one course has been booked the exam voucher is valid for 90 days from the last day of the first course booked
3. Where more than one course has been booked the exam voucher must be requested within 90 days of the last day of the first course
4. All quizzes must be taken and passed in the student portal prior to booking an exam
5. There is no cash alternative to the exam voucher
6. There is no discount on the course fee
7. This offer is not retrospective
8. Excludes courses financed via Pay4Later/Ratesetter
9. In circumstances where the student postpones a course for a later date the 90-day window is still counted from the last day of the
original course date booked.
10. To apply for an additional 3-month extension to the exam voucher there is a fee of £100+vat

12. Exam Bookings
If you have purchased an exam together with your classroom course, we will book the exam on your behalf at your chosen test centre upon your request. Please note that we will only book an exam for you within 90 days of your course attendance.

Request for exam bookings must be made using the prescribed form, exam booking can take up to 7 days to complete.

If you cancel or postpone your exam you will be charged £100+vat admin fee to cancel or rebook

If you have purchased an exam together with your online course, we will book the exam on your behalf at your chosen test centre upon your request.

Pearson Vue (The examination body) sets the prices for the exams. Therefore any shortfall caused by an increase in exam prices between the point of booking a course and taking the exam will need to be paid by the student prior to the exam being booked.

We are unable to cancel/postpone exams on your behalf. There is strictly no cash alternative to exam vouchers.

13. EXPORT OR RE-EXPORT LIMITATION
Notwithstanding any other provision of this Agreement, the training, products, services and/or technical data covered by this Agreement, can only be delivered subject to Commsupport Networks obtaining the required export licence or authorisation from the UK Trade and industry department as required by the Export Administration Regulations. Regardless of any disclosure made by the Purchaser/Delegates to Commsupport Networks of an ultimate destination of the products and/or technical data, it is the Purchaser’s sole responsibility to obtain the necessary approvals from the UK Government and other government authorities before exporting from the country of purchase any such products or technical data

14. ASSIGNMENT
The Purchaser will not assign the benefit of this Agreement without obtaining the prior written consent of Commsupport Networks.

17. PROPER LAW
The proper law governing this agreement shall be English and the forum for settling any disputes under this Agreement shall be the English courts.
